Abstract:

This workshop will revisit the question of the horizontal effect of constitutional rights in the time of climate change, pervasive political populism and digital social media platforms. It will pivot on the discussion of papers presented by Joel Bakan (University of British Columbia), Richard Mailey (University of Alberta), Gautam Bhatia (Jindal Global Law School, New Delhi and Oliver Gerstenberg (University College London UCL). Assigned discussants of the papers will be Frank Michelman (Harvard University), Mark Tushnet (Harvard University) Stephen Gardbaum (Berkely University) and Adreas Kulick (University of Mainz).
