The conference explores the definition and application of the principle of conferral after the entry into force of the Lisbon Treaty. It is argued that, from a sequential perspective, this is the first structural principle to be addressed in any given case. The Lisbon Treaty does not remain neutral in this respect but instead clearly (re-)affirms the Member States in their role of masters of the Treaties. Instead of offering stability, clarity and certainty, the Lisbon Treaty has triggered many cases with a renewed line of questioning. The main topics addressed are: What types of conferral can one identify in the Treaties (full, crippled, split) /How does this (potentially) impact the case-law of the Court of Justice.

Speaker

Inge Govaere is a professor of European Law and Director of the Ghent European Law Institute (G.E.L.I.) at Ghent University as well as Director of the European Legal Studies Department at the College of Europe in Bruges. She obtained her PhD at the European University Institute (EUI) in Florence. Professor Govaere has been a guest lecturer and visiting professor at many universities all over the world, including Cornell University (Ithaca NY, USA) and Cambridge Unive                         rsity (UK). Her academic interests are very vast – from EU external relations to intellectual property rights. Her most recent publications include "TTIP and dispute settlement: potential consequences for the autonomous EU legal order", which she also presented at the FIDE conference in Budapest and “To Give or to Grab: the Principle of Full, Crippled and Split Conferral of Powers Post-Lisbon”, in M. Cremona (ed), Structural Principles in EU External Relations Law, (Hart Publishing, 2017). The Division of Competences between the European Union and its Member States: Reflections on the Past, Present and Future (Hart Publishing, 2017) is her latest book.

 

Lecture Series “The European Union as a Global International Actor: Competence and Representation”

Organised by Prof. Eleftheria Neframi and Dr Mauro Gatti, University of Luxembourg, Robert Schuman Institute of European Affairs

The conference of Prof. Inge Govaere is part of the Lecture Series on the theme The European Union as a Global International Actor, supported by the FNR (RESCOM Scientific Events). The objective of the Lecture Series is to involve a wide- ranging audience in interactive lectures delivered by renowned scholars in legal or political economy disciplines. The lectures cover various aspects of the external action of the European Union and aim at critically assessing its role in tackling challenges in a context of global governance. 27 conferences have been organized from March 2014 to December 2016. The Lecture Series held from October 2017 to January 2018 will address controversial questions concerning the EU competence and external representation.
