PRESIDENT OF THE CURATORIUM OF THE HAGUE ACADEMY OF INTERNATIONAL LAW

The question of whether Public International Law takes inspiration from the civil law system or the common law system does not seem ever to have been directly or clearly posed.

This situation can probably be explained by the fact that, when looking at the traditional and general international law, the question was more or less redundant, insofar as the fundamental bases of international law, being of a moral or religious nature, transcended this distinction. Nevertheless the question is worthy to be put.

On the other hand, as soon as one ventures into the more specialised sphere of economic, commercial or technical international law, requiring specific legal techniques, the question of the common law or civil law origin of that special law, with its potential for comprising a mixture of both public and private international law, may become crucial.

The lecture will be followed by a cocktail.
